Comments:
A monitoring inspection was conducted on 07/18/2023. The inspector was on site from approximately 9:00 am - 10:25 am. There were a total of 5 children (17 points) observed with 2 caregivers. The provider was not on site during the inspection. The children were engaged with the caregivers. The inspector reviewed compliance in the areas of administration, personnel and household members, physical environment, care of children, handwashing, diapering, medication, emergencies and nutrition. A total of 5 child records and 2 caregiver/household member records were reviewed. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to me within 5 business days from today. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Please do not use staff names; list staff by positions only.

Standard #: 22.1-289.035-B-2
Description: Based on a review of records, the provider did not ensure caregivers had documentation of a completed Nationwide fingerprint search on file prior to employment.

Evidence:
Caregiver 1 and 2 (DOH 7/17/23) did not have the results of a nationwide fingerprint search on file.

Plan of Correction: Nationwide fingerprint search is available for caregiver 2 as of July 21st, 2023.
Nationwide fingerprint search was processed for caregiver 1 on July 22nd, 2023.

Standard #: 8VAC20-770-60-B
Description: Based on record review, the provider did not ensure each caregiver had a sworn disclosure statement prior to the first day of employment.

Evidence:
Caregiver 1 and 2 did not have a sworn disclosure statement on file during the inspection.

Plan of Correction: Documentation was available for both caregivers but not located by household member available on the day of the inspection.
All documents are now available on site.

Description: Based on a review of records, the provider did not maintain a record for each caregiver.

Evidence:
Caregiver 1 and 2 (date of hire 7/17/2023) did not have a record on file during the inspection.
Caregiver #1 was missing verification of age, job title, date of employment, two references, background checks as required by 8VAC20-770, documentation of TB screening as required by 8VAC20-800-170, and documentation of education and training as required by 8VAC20-800-230.
Caregiver #2 was missing name, address, verification of age, job title, date of employment, two references, background checks as required by 8VAC20-770, documentation of TB screening as required by 8VAC20-800-170, documentation of education and training as required by 8VAC20-800-230, and documentation for name and telephone of a person to call in case of an emergency.

Plan of Correction: Evidence of age, job title, date of employment and 2 references were available, but not located by household member available on the day of the inspection. Documentation of TB and education was available for caregiver 1 but not located by household member available on the day of the inspection.
All documents are now available on site.

Standard #: 8VAC20-800-30-A
Description: Based on observation, the provider did not ensure compliance with the standards and the terms of the current license issued by the department and with relevant federal, state or local laws, and other relevant regulations.
Evidence:
The provider left the family day home operations under the guidance of 2 caregivers for approximately 5 hours that were not qualified to be substitutes and that did not have the required paperwork to be a caregiver.

Plan of Correction: Paperwork for our caregivers was missing on the day of the unexpected inspection. Paperwork is now active and available to review on site.

Standard #: 8VAC20-800-140-B-1
Description: Based on a review of records, the provider did not ensure that the caregivers left in charge of the daycare were qualified to be substitutes.

Evidence:
Caregiver 1 and 2 did not have documentation of a high school program completion or the equivalent.

Plan of Correction: Document for substitute teacher is available for future inspections.

Standard #: 8VAC20-800-140-B-2
Description: Based on a review of records, the provider did not ensure that the caregivers left in charge of the daycare were qualified to be substitutes.

Evidence:
Caregiver 1 and 2 did not have documentation of 3 months of programmatic experience.

Plan of Correction: Document for substitute teacher is available for future inspections.

Standard #: 8VAC20-800-170-A
Description: Based on record review, the provider did not ensure caregivers obtained their Report of Tuberculosis Screening form prior to coming into contact with children.
Evidence:
Caregiver 1 and 2 (date of hire 7/17/2023) did not have a TB test or screening form available for review during the inspection.

Plan of Correction: TB was available for caregiver 1 but not located by household member available on the day of the inspection. Caregiver 2 has an appt. scheduled for a test.

Standard #: 8VAC20-800-230-A
Description: Based on a review of records, the provider did not ensure written documentation of each caregiver?s education and programmatic experience was on file.

Evidence:
Caregiver 1 and 2 did not have proof of education or experience on file during the inspection.

Plan of Correction: Documentation for substitute teacher is available for future inspections.

Standard #: 8VAC20-800-650-C
Description: Based on a review of documentation, the provider did not notify parents when a substitute provider will be caring for children.

Evidence: There was no documentation of notifying parents that the provider would not be in the family day home an extended amount of time.

Plan of Correction: Documentation for substitute teacher is available for future inspections.
