63.2 Child abuse and neglect

Comments:
A complaint investigation was conducted on September 20, 2023, in response to a complaint received by the licensing office about the supervision of children. Additional local agencies are also investigating this complaint.

The family day home was inspected, Interviews were conducted and records were reviewed. A preponderance of the evidence supports the claims made in the complaint and it is deemed to be valid. Violations pertaining to this complaint and other areas of non-compliance can be found on the violation notice.

Complaint related: No
Description: Based on observation, the findings from the most recent licensing inspection were not posted in the facility.
Evidence:
The findings from the renewal inspection conducted on 1/3/2023 were not posted in the facility on the date of inspection.

Plan of Correction: I was not aware of that fact, but now knowing that need to be post it has been corrected already.

Description: Based on record review and observation, the provider failed to report to the department a lost or missing child when local authorities have been contacted for help, within 24 hours of the incident.
Evidence:
Children went missing from the family day home on 9/15/2023. The department was informed of the missing children on 9/19/2023 from an outside agency. The provider did not contact the licensing office or the inspector.

Plan of Correction: The provider was not aware of this requirement, but now knowing of that fact it will be implement if ever must.

Evidence:
The record for Child 2 did not contain documentation of a physical examination.

Plan of Correction: The children 2 was not over the 30 days attendance, so those documents (physical examination) were pendant by the parent.

Description: Based on local agency reports and interviews, the provider failed to ensure that the home's activities, services, and facilities are conducive to the welfare of children in care.
Evidence:
1. On 9/15/2023 Child 1 and Child 2 were found alone, attempting to cross Old Meadow Road and Wilson Lane by a citizen who contacted law enforcement at 12:05pm.
2. The location where the children were found is approximately 800 feet from the family day home.
3. According to the children?s parent, the children had been dropped off at the family day home between 11:15am and 11:45am with Household Member 1 while the provider was at a neighborhood playground. The parent stated that they historically would leave the children with Household Member 1 if the provider was not home.
4. The children left the family day home through a patio door while Household Member 1 was using the upstairs bathroom.
5. The parents were notified by law enforcement that their children had been missing and were now located at 12:39pm.

Plan of Correction: 1. The provider meets the children with legal authorities on the corner of Kenneth Dr. and Kenneth Dr. (both streets have the same name)
2 the provider meets them approximately 400 feet from the day care.

3. The member had report that the children were drop off approximately 11:45AM-12PM. And the provider went out the house at 11:35 and the provider know that because she started to get the children by 11:30AM
4. the patio door is always lucked, and none of children ever even try to open before. This was the first-time a child cold unlocks the patio door. also the provider added an addition locker at the top of the patio door to prevent an future occurrence of that nature.

5. The provider started to search desperately for the children as sooner she was notified the disappearance of them.

Description: Based on record review and interviews, the provider failed to keep a written record of children in attendance each day.
Evidence:
1. The attendance for 9/15/2023 did not contain the attendance of Child 2.
2. According to parent and household member statements, Child 2 was dropped off for care approximately between 11:15am and 11:45am on 9/15/2023.
3. Child 2 does not appear on any of the previous three weeks of attendance records despite interviews confirming the child?s presence at the daycare during that period.

Plan of Correction: 1. It was the parent responsibility to sign the children attendance, but now knowing this importance of the fac the provider will be extra careful in this matter.

Description: REPEAT VIOLATION

Based on record review, children?s records did not contain all required information.
Evidence:
1. Child 1?s record did not contain: the child?s first date of attendance; the child?s health insurance policy number; the information for one of two required emergency contacts; Written authorization if the child is to participate in swimming or wading activities; Written authorization if the child is taken off the premises of the family day home.
2. Child 2?s record did not contain: the child?s first date of attendance, the information for one of two required emergency contacts; Written authorization if the child is to participate in swimming or wading activities; Written authorization if the child is taken off the premises of the family day home; a record of immunization; documentation of a physical examination; proof that the child?s age and identity was verified by the provider.

Plan of Correction: Most of the outside activity was consent by the parent in case over a text message and verbally and for all other patents I do have written authorizations, but now knowing the importance of this matter, I will be very carefully in get all in written authorization from all parents for the record.

Description: Based on record review, the provider failed to provide in writing all required information to parents prior to their child?s attendance.
Evidence:
The record for Child 1 and Child 2 did not contain documentation that the parents had been informed of all required information to include drop off procedures and children's daily schedule.

Plan of Correction: On many occasions the parents of the children in question were informed verbally about the drop off procedure and daily schedule.

Description: Based on record review and interview, the provider did not obtain verification of the age and identity of a child within seven days of enrollment.
Evidence:
The record for Child 2 did not contain documentation that the child?s age and identity had been verified. Interviews confirmed that the child had been enrolled for a period of longer than 7 days.

Plan of Correction: Please double check you record of that fact, because I do have in file child 2 birth certificate.

Description: Based on local agency reports and interviews, the provider failed to ensure that a caregiver was physically present and providing direct supervision of each child at all times.
Evidence:
1. On 9/15/2023 Child 1 and Child 2 (aged 3 years and 23 months) were dropped off at the provider?s residence with Household Member 1 between approximately 11:15am and 11:45am while the provider was at the playground with other enrolled children.
2. The parent stated that they regularly drop off their children to Household Member 1 on occasions when the provider was not at home.
3. Household Member 1 went to use the restroom for approximately 7-10 minutes on the second floor, leaving the children unattended on the first floor.
4. The children were observed by a citizen attempting to cross the intersection at Old Meadow Road and Wilson Lane (approximately 800 feet from the provider?s residence). The citizen then called law enforcement at 12:05 pm.
5. Household Member 1 returned from the restroom, noticed the children were missing and began searching the neighborhood for the children.
6. At 12:39 pm law enforcement notified the parents that their children had been missing from the provider?s care and had been recovered.

Plan of Correction: 1. On Sep 15-2023, The children in question were dropped off at the day care by a parent with a member of the house without my knowledge. And the parent never notified me of the presence of the children in the day care at that day.
2. Neither the children in case or other child were ever left at the day care by their parents without my presence or with any other member of the house. So, what proof the parent must state that they left those children in the day care before this incident?
3. There is not an exact time confirm, but the member state couple of minutes.
4. The family member told the parent that the provider was not at home, and she had already gone to the playground with other children as she does as part of the day care routine, which all parent are aware of it.
5The member 1 returning from the bathroom noticed the absence of the children and saw the back door open and immediately went out in search of the children as the same time was colling the provider to notify her.
6. The children however were not under the provider care since she ws not previews notification from the parent the children were dropped in the day.
