Comments:
An unannounced inspection was conducted on December 21, 2022, from 11am to 12pm. There were no children present at the time. The Inspector reviewed five children?s records and the provider?s record. First aid kits and emergency preparedness documents were observed. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented. The violations are listed on the violation notice issued to the center and were reviewed with the provider at the exit interview.

Violations:
Standard #: 22.1-289.035-A
Description: Based on record review and interview, it was determined that the center did not ensure that all employees shall undergo a background check every five years.
Evidence:
1. The provider, Staff #1, has an expired criminal background check dated December 3, 2023.
2. The Family Day Home confirmed that their criminal background check is expired for Staff #1.

Plan of Correction: The provider responded with the following: The provider will complete their criminal background check and have the information forwarded to the Department of Education within 10 business days.

Standard #: 8VAC20-770-60-B
Description: Based on record review and interview, it was determined that the center did not ensure that a child's record shall contain the name, address and telephone number of two designated persons to contact in case of an emergency if the parent cannot be reached.
Evidence:
1. Child #1 (date of enrollment 11/15/23) has only one of the two designated persons to contact in case of an emergency.
2. Child #3 and Child #4 (date of enrollment 9/06/23) did not have the required two designated persons to contact in case of an emergency.
3. Staff #1, confirmed that Child #1, Child #2, and Child #3 did not have the required emergency contact information in their record.

Plan of Correction: The provider responded with the following: The provider will obtain the emergency contact information for Child #1, Child #2, and Child #3 the next time they are at the center and also text the parents for the information to obtain for the child?s record.
