8VAC20-790 Subsidy Program Vendor Requirements for Family Day Homes

Technical Assistance:
All caregivers are required to complete the 3-hour subsidy "annual update" training.

Comments:
An unannounced subsidy health and safety inspection was conducted on 02/09/2024 from 10:10 am - 11:10 am. There were two children in care with one caregiver during the inspection. The ages of the children counted for a total of 4 points.
A licensing inspection was also conducted on this date. Both inspections combined cover subsidy health and safety regulations. Only subsidy requirements that are not covered in licensing standards were reviewed during this supplemental inspection.

Information gathered during the inspection determined non-compliance with applicable standards and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-790-170-G
Description: Based on interview and home review, the vendor failed to maintain, in a way that is accessible to all caregivers, a current written list of all children's allergies, sensitivities, and dietary restrictions. This list shall be dated and kept confidential.

Evidence:
1. There was not a current written list of all children's allergies, sensitivities, and dietary restrictions that the inspector was able to locate in the family day home.
a. Caregiver 1 stated she was not aware of any allergy list and that she did not have access to the children's records during the vendor's absence.
2. A review of children's records, provided later during the inspection by the vendor, contained written documentation that one child in care had diagnosed food allergies.
a. The vendor verified that there was no written allergy list available to caregiver 1.

Plan of Correction: The vendor stated that a written allergy list will be accessible to all caregivers.

Standard #: 8VAC20-790-190-B-12
Description: Based on record review and interview, the vendor failed to obtain a written care plan for each child with a diagnosed food allergy, to include instructions from a physician regarding the food to which the child is allergic and the steps to be taken in the event of a suspected or confirmed allergic reaction.

Evidence:
1. There was no written allergy care plan on file for child 1 who has diagnosed food allergies.
a. The vendor confirmed that a written allergy care plan was not on file for child 1.

Plan of Correction: The vendor stated that the parent of child 1 will be asked to provide a written allergy care plan from the physician of this child.
