Comments:
An unannounced complaint inspection was initiated on 03/01/2024 (10:03 am) and completed on 03/01/2024 (11:55 am) in response to a complaint regarding termination procedures for the FDH.

Based on the information gathered this complaint is found to be valid. A violation was found in the administrative area of the FDH regulations. This violation is listed on the violation notice issued to the FDH and was reviewed with the provider at the exit interview.

Complaint related: Yes
Description: Based on record review and interview, the provider failed to ensure compliance with the home's policies that have been disclosed to the parents as required by 8VAC20-800-70.

Evidence:
1. The provider failed to ensure compliance with written termination policies as demonstrated by the following:
a. The written termination policy for the FDH, which is outlined in the parent agreement, states that a two-week notice will be given if the child's enrollment is terminated by the provider.
b. Written documentation indicated that child 1 was terminated from care on 01/31/2024 and that the termination was immediate.
c. The provider verified that child 1 had been terminated from care without the two-week noticed outlined in the parent agreement for the FDH.

Plan of Correction: Provider has stated that the written policy for the FDH will be revised to include information noting that if a child has persistent or unforeseen behavior challenges the normal two-week termination policy may be suspended to include immediate dismissal.
