Comments:
An unannounced Renewal inspection was attempted on 4/12024. The Family Day Home was not operating at the time due to a temporary, extended, scheduled closing. The renewal inspection was conducted on 4/9/2024 from 10:20 am - 12:50pm. At the time of entrance, 11 children were in care with the licensee and 2 assistants present. The sample size consisted of 5 children?s records and 4 provider / Assistant / Household Member records. Children were observed having a morning snack, singing and dancing to music, eating lunch and settling onto cots for rest period. Hand washing, restroom procedures, table sanitizing and food service were observed. The provider does not administer medication to children in care and does not transport the children in a vehicle while in care. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program. Repeat violations were found and are identified within this report.

Violations:
Standard #: 22.1-289.035-A
Description: Based on a review of records and interview, the licensee did not ensure that all employees undergo the required background checks before beginning to serve as a volunteer and every five years thereafter.
Evidence:
Four caregiver / Assistant. / Household Member records were reviewed.
The record for caregiver #3 contained the most recent results of a Criminal History Record check which were dated 1/25/2019, more than 5 years ago.
The record for caregiver #3 contained the most recent results of a Search of the Central Registry check which were dated 2/12/2019, more than 5 years ago.
The licensee confirmed that this was an oversight and that a new request for an updated Criminal History Record Check and an updated Central Registry search had not been completed.

Plan of Correction: The provider stated that was an oversight as caregiver #3 had just returned to work after an extended leave and the licensee did not realize that the Results had been obtained more than 5 years ago, A Central Registry request will be sent and an appointment will be scheduled before the end of the week to have a new request for an updated Criminal History Record Check completed for caregiver #3.

Standard #: 8VAC20-790-180-A
Description: ***REPEAT VIOLATION***
Based on a review of records and interview, the licensee did not obtain for each caregiver a current Report of Tuberculosis Screening form, in accordance with the requirements in 8VAC20-800-170, every two years from the date of the first screening or more frequently as recommended by a physician or the local health department.
Evidence:
Four caregiver/ Assistant / Household Member records were reviewed.
The record for caregiver #3, who was working with children during the inspection, contained the most recent result of a Tuberculosis screening which was dated 2/5/2019 and was read more than 2 years ago. The licensee confirmed with caregiver #3, who had just returned to work from an extended leave, that she did had not obtained a more recent screening.

Plan of Correction: The Licensee stated that caregiver #3 had just retuned from an extended leave and she did not realize that her TB screening had expired. The Provider will require that caregiver #3 obtain an updated Tuberculosis screening within 10 days and follow up to obtain results which will be placed in caregiver #3's record.

Standard #: 8VAC20-800-880
Description: Based on observation and interview, the licensee did not ensure that when meals or snacks are provided by the family day home, they follow the most recent, age appropriate nutritional requirements of a recognized authority such as the Child and Adult Care Food Program of the United States Department of Agriculture (USDA).

Evidence:
The children were observed eating a snack which consisted of a cereal bar and water.
When asked if the children had been served any additional food components, it was confirmed that they there had been a change in the menu and the children had not had any additional food or drink for their snack. Snacks must include a minimum of 2 separate food components and water is not considered a food component.

Plan of Correction: The licensee stated that she will ensure that a second food is served as part of snack when children prefer to drink water instead of milk. The menus will be adjusted to reflect that beginning tomorrow.
