22VAC40-185 STAFFING AND SUPERVISION.
An unannounced other inspection was conducted on May 5, 2015 and July 1, 2015 in response to a self reported incident that occurred on April 29, 2015. The facility reported to the Licensing Office that a child exited the building and was found by the school bus driver. Licensing Inspector interviewed staff and collateral witness involved. Based on the information obtained it is determined the the facility is in violation of supervision, care and protection of children and staff/child ratio requirements. Please see violation notice for further details. This inspection will be discussed with Licensing Administrator regarding further action by the department. Violations were reviewed with and verified by Program Director during the exit interview conducted on July 1, 2015.
Standard #: 22VAC40-185-340-A Description: Based on interviews with staff and collateral, the facility failed to ensure care, protection and guidance of children in care. Evidence: 1. On April 29, 2015, child 1 exited the building and ran to Route 5, a heavily traveled two-lane road with a speed limit of 35 mph. The road is approximately 215 feet from the door child exited. 2. Staff reported child 1 "is a runner" although she had never gotten out of the building before. 3. An older child, age 5, informed staff child 1 had left the classroom. 4. A school bus driver and assistant alerted traffic to stop for the child. Bus driver and assistant retrieved the child and brought her onto the bus. Plan of Correction: The half door leading into the classroom will be replaced with a full door that has a magnetic locking system. Both entry doors will be secured with a touch button release as opposed to a motion sensor. The touch button release with be within adult reach only. The plans have been submitted and approved for work to begin. Staff will maintain sight and sound supervision of children at all times. This was reviewed with all staff.
Standard #: 22VAC40-185-340-F Description: Based on interviews, facility did not ensure children under the age of 10 years are within actual sight and sound supervision of staff. Evidence: 1. On April 29, 2015 between approximately 7:35 - 7:45 AM, child 1 (age 4), exited the building and was found by a school bus driver. 2. Bus driver reported entering the facility driveway on April 29, 2015 and observing child 1 running from the facility towards Route 5. Bus driver yelled from the window instructing the child to stop but the child did not. Bus driver began blowing the horn to alert traffic to stop. Bus driver's assistant got out of vehicle to get the child. Bus driver's assistant reached child at Route 5 where cars were stopped. Bus driver's assistant brought child onto the bus. Bus driver and assistant drove child 1 in bus back to the entrance of the facility. Bus driver reported a staff member came outside the facility entrance appearing to be looking for the child. 3. Staff reported child had been present in the classroom with staff 1 and staff 2. Staff 2 was talking with an upset child that was being dropped off and staff 1 was assisting another child. An older child, age 5, told staff 1 that child 1 left the room. Then staff 1 began looking for child to include alerting the Program Director in the adjoining room. Staff 1 walked out the front of the building and saw child 1 in the school bus. Staff reported child could not have been gone more than 2 minutes. Standard #: 22VAC40-185-350-E-4 Description: Based on interviews and review of documentation, facility did not ensure there is at least 1 staff for every 10 children when the youngest in the group are 3 years old. Evidence: According to review of sign in sheets and interviews with staff, there were 2 staff present with 22 children ages 3 - 12 years old on April 29, 2015 at 7:30 AM. Plan of Correction: All licensing standards have been reviewed with all staff and staff/child ratios must be maintained at all times.
