A complaint was received by The Department of Social Services Central Regional Licensing office on March 26 ,2015 concerning transportation. The licensing Inspector conducted an unannounced inspection in response to the complaint on March 30, 2015. The facilities Director/Owner and staff were interviewed, center policies and field trip permission slips were reviewed. Based on the information gathered during the investigation, the preponderance of evidence supports the allegation, therefore the complaint is valid (see violation notice). Standard #: 22VAC40-185-580-C Complaint related: Yes Description: Based on interview, the facility did not ensure that Virginia state statutes about safety belts and child restraints were followed. Evidence: Per the Director when asked about an a field trip that took place to the library on March 13, she stated that child #1 had attend and was transported in the facilities van. The Director stated that child #1 had been seat belted in the van but did not have a booster seat as Virginia State law requires for children until their eighth birthday. Child #1 is three years old. Plan of Correction: Per the Director: The staff did not follow our transportation policies and procedures. Staff was reprimanded and to ensure this situation does not occur again, we will not offer field trips with our young age groups. I met with the staff and the parent on March 17, 2015 to find a solution to issue that occurred.
Standard #: 22VAC40-185-580-L Complaint related: Yes Description: Based on review of permission slips and interview, the facility did not secure parental permission for transportation and field trip before the scheduled activity. Evidence: Child #1 was transported to the library for a field trip on March 13, 2015. The parent had not given permission for the child to participate in the activity nor be transported off of the facilities property. Their was no written permission slip for child #1. Plan of Correction: Per the Director: We were aware the child was not to attend the field trip however staff accidently included the child in the group who were attending the trip to the library when lining up. Transportation polices and procedures were reviewed with staff. I am discontinuing field trips that require children to leave the facility to ensure transportation issues do not occur again.
