Comments:
An unannounced monitoring inspection of the facility and records was conducted from 9:50am? 10:40am. There were 18 children present with two staff. Four children?s records were reviewed. Emergency contact information was reviewed for all staff present. Interviews were conducted with children and staff present. Staff records are stored at a central location and will be reviewed at a later date. Children were observed in circle time, story time, transitions, outside play, restroom routines, hand washing, teacher and self-directed activities. The inspector reviewed current insurance documentation, fire and health inspection and emergency evacuation drills. A walking tour of the outside play space was conducted. The following violation was observed and will appear on the violation notice:children walking around while drinking and lack of care and protection.

Violations:
Standard #: 22VAC40-185-340-A
Description: Based on observation and interview the center failed to ensure that when staff are supervising children they shall always ensure their care and protection. Evidence: 1 - Child 1 was observed climbing up on to the seat of one chair and walking across the seat of nearby second chair then jumping to the floor. 2 - There were two staff present. However, the staff did not intervene in any way. 3- Child 1 and child 2 were physically struggling over a chair that child 2 had been sitting in. Child 1 attempted to pull child 2 out of the seat. Child 2 pushed child 1 away. Child 1 grabbed child 2's hair and pulled hard enough for the child to loose her balance. Child 2 began to cry. 4 - There were two staff present during the incident. However, no staff intervened until the inspector called attention to the crying child and reported to staff 2 what had taken place.

Plan of Correction: Referral requests have been made by the cite manager so that evaluations can be made of specific children to determine their needs.

Standard #: 22VAC40-185-560-N
Description: Based on observation the center failed to ensure that no child shall be allowed to drink or eat while walking around. Evidence: 1 - After outside play the children were allowed to go to the water dispenser to get a drink of water. Staff 2 handed each child a cup of water. The children then moved around the room while drinking the water. 2 - None of the staff present asked the children to sit down to drink their water.

Plan of Correction: Center management will retrain all staff in the requirement that children be seated while drinking.
