22VAC40-191 Background Checks (22VAC40-191)

An unannounced monitoring inspection was done today October 27, 2015 beginning at 9:30 AM and ending at 2:30 PM. There were twenty-one children in care today. The children were observed in their classrooms playing in centers, listening to stories, reviewing shapes, directions and singing in circle time.. They were playing with table and floor toys. The outside play area was not reviewed today due to the rain. There is no medication administered at the center. The inspector did review staff and children's files. This included newly hired staff and enrolled children. The violations were discussed with the staff member in charge as well as corrective action. Standard #: 22VAC40-185-70-A
Description: Based on observation the staff files did not contain all of the required documentation. Evidence: 1. During the inspection the LI reviewed the files of new staff # 4 & 5 and they were missing some of the documentation required for references. Missing information for both was the date of reference contacts, signature of person who made the contact and results of the contact. Staff # 4 was also missing documentation of the orientation given.

Plan of Correction: Staff # 2 indicated she would let the PD know what was needed and documentation will be added.

Description: Based on observation the annual fire inspection had not been done.
1. During the inspection the LI asked for the annual fire inspection and it was not available.

Plan of Correction: Staff # 2 indicated she would check with the PD to determine if an inspection had been done. If it has not, one will be scheduled.

Standard #: 22VAC40-185-340-F
Description: Based on observation the center did not keep the children within sight supervision at all times during nap. Evidence: 1. During nap time the LI observed the children ages 4-5 years old sleeping in the two classrooms on the lower level. Staff # 1 was the only staff member present to observe the children in both classrooms. Staff # 1 indicated that on some days staff # 5 would also be present but on this day was helping with the two's class. When the LI entered the first classroom, staff # 1 was in the second classroom.

Plan of Correction: Staff # 2 indicated she would let the PD know of the changes needed to have supervision at all times.

Standard #: 22VAC40-185-380-A
Description: Based on observation the center did not have flexible daily schedules posted for the age groups in care. Evidence: 1. During the inspection the LI observed the only schedule posted was in the four/five year old class. This schedule indicated only the morning activities.

Plan of Correction: The teachers indicated they would post a daily schedule that reflected the flexible activities for the entire day.

Standard #: 63.2-1720-F
Description: Based on observation the center allowed new staff to supervise children alone prior to the return of criminal history checks. Evidence: 1. During the inspection the LI observed staff # 4 alone with the four year old class in the position of teacher. Staff # 1 indicated that at times new staff # 5 supervises the children in one of the lower level classrooms during nap. The LI reviewed the files of staff # 4 & 5 and the criminal history checks have not been returned for the new staff.

Plan of Correction: The PD/owner brought in the criminal history checks that were received in the mail today. She will adhere to the standard for any new hires.
