An unannounced inspection was conducted today from 10:05am-12:00pm in response to a self-reported incident regarding inappropriate form of punishment. Based upon multiple interviews, the preponderance of evidence does support a violation for forbidden actions and another non-related violation was cited and is identified in the Violation Notice. Standard #: 22VAC40-185-40-E Description: Based on staff interviews, the center's activities and services were not maintained in compliance with the center's own policies and procedures that are required by the standards. Evidence: 1. The center's policy regarding unacceptable child guidance was not followed when a teacher instructed a 3 year old child to hold their arms out to their side as a form of punishment, as the Employee Handbook states "spanking, grabbing, pinching, or any physical punishment or restraint" are discipline methods that are not acceptable. 2. Interviews confirmed that Staff A had taken a video of enrolled children via a personal cell phone and posted the video on Snapchat, which is a social media video messaging application. The center's policies regarding photographs and technology states that "All KU-issued computers, phones, cameras, or other technology are KU property and should only be use for work purposes" and also "Do not use your own camera or phone." The policy further states that "photos or videos, or information about children enrolled in KU programs should not be posted to any external social media site, website, blog, feed, or other online sharing platform." Plan of Correction: Staff member was terminated and all staff will be retrained on positive guidance. Staff will attend positive guidance trainings twice yearly. All staff have signed off on KE policy on social media and staff photographing and posting KE children on social media.
Standard #: 22VAC40-185-410-1 Description: Based on staff interviews, a staff member participated in the forbidden action of forcing a 3 year old child to assume an uncomfortable position as punishment. Evidence: 1. On February 19, 2016 at approximately 2:00pm, as Staff B was bringing in a group of School Age children from the bus, Staff B observed Child 1 standing in the classroom with their hands out to the side. As Staff B was transitioning the School Age children, Staff B noticed that Child 1's arms were down. Staff B then heard Staff A say to Child 1 "why are your hands down?" After Staff B left to move the bus and returned to the classroom, Staff B heard Staff A tell the child to "put your arms back up." Staff B immediately informed Staff A that they could not do that and Staff A stated that Child 1's mom told Staff A to have the child to put their arms out to the side as a form of punishment. 2. Staff C witnessed Child 1 with their arms out to the side, saw Staff B speaking with Staff A, and then saw Child 1 put their arms down. Staff E also witnessed Child 1 with their arms out and confirmed that Staff A stated that Child 1's mom instructed Staff A to have Child 1 put their arms out as a form of punishment. 3. Staff D did not witness the incident but confirmed that Staff A informed Staff D of the incident and stated that Child 1's mother told them to have Child 1 to put their arms out as a form of punishment to calm the child down. Plan of Correction: Staff member was terminated and all staff will be retrained on positive guidance.
