22VAC40-191 Background Checks (22VAC40-191)

An unannounced monitoring inspection was conducted on 7/21/2016 from 10:10am - 1:00pm. At the time of entrance the following staff to child ratios were observed: *2's - 16 x 2 staff *3's - 16 x 2 staff *4's - 21 x 2 staff *SA - 27 x 2 staff *SA - 25 x 2 staff - this class was on a field trip Children were observed engaged in outdoor water play. Morning program time, lunch and nap was observed. Preschool children were observed having their pictures taken by an outside photographer. Hand washing was reviewed for all classrooms. Additionally reviewed: medication, emergency supplies, documentation of children's minor injuries, three staff records, four children's records, attendance documentation, staff training, the posted menu, sunscreen and field trip/transportation procedures. Please complete the "plan of correction" for each violation cited on the violation notice and return it to me within 10 calendar days from today. You will need to specify how the deficient practice will be or has been corrected. Just writing the word "corrected" is not acceptable. Your plan of correction must contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s).

Standard #: 22VAC40-185-280-B
Description: Based on observation, the center failed to ensure that hazardous substances such as cleaning materials shall be kept in a locked place using a safe locking method that prevents access by children. Evidence: 1. A can of disinfectant spray was observed on the floor in the classroom being utilized for professional photographs of the children. a. The spray had been placed on the floor by the photographer. 2. Children were observed sitting in chairs near the carpet where the disinfectant had been placed. 3. This product contained a warning labeled indicating the contents were hazardous.

Plan of Correction: This spray was being used by the photographer and was put away during the inspection. Center management had asked this individual, previously, to keep this product away from the children however, he brought the spray out later that morning and failed to put away as requested earlier. In the future, staff will be asked to be alert for these situations in order to avoid "contract staff" from leaving potentially hazardous products unlocked.

Standard #: 22VAC40-185-350-C
Description: Based on observation, record review and interview the center failed to ensure that when children are regularly in ongoing mixed age groups, the staff-to-children ratio applicable to the youngest child in the group shall apply to the entire group. *For children, from age of eligibility to attend public school through eight years, one staff member for every 18 children; and *For children from nine years through 12 years, one staff member for every 20 children. Evidence: 1. Two staff were observed with 30 school age children at 11:00am. a. Staff working in this classroom reported the majority of the children were under the age of eight years however, there were a few children up to the age of 13 in care with the group. 2. At 11:06am staff #2 left the room in order to assist an official with a public agency. a. This left staff #4 alone with 30 school age children. b. There were no additional staff in the center to assist staff #4. 3. Staff #2 returned to the classroom approximately five minutes later however, she had to leave the room again in order to further assist the official with a public agency. a. During this time two additional children arrived bringing the total number of children in group to 32. b. Staff #4 was alone with this group. 4. While staff #2 was assisting the public official a parent arrived who also needed assistance. Staff #2 remained in the lobby and office area of the center in order to assist the parent. 5. Staff #2 resumed her duties in the school age class at 11:33am. a. Staff #4 was left alone with 32 school age children for approximately 15 to 20 minutes.

Plan of Correction: Staff #2 told the local official three times that she could not leave the classroom as she was needed to count in the staff-to-child ratio of the group. The local official insisted she leave the room in order to assist with what he needed. Staff #2 felt she had not choice but to comply with this request. Staff #2 provided the written documentation to this official and quickly returned to the class however, the local official returned and again requested her assistance outside of the classroom. Staff #2 again, felt she had not choice and therefore, left the class to try and assist this official with what was requested. During this time a parent arrived and staff #2 assisted this parent as quickly as she could. The program director returned to the center and staff #2 returned to the school age classroom. In the future, staff will be trained on the logistics of re-grouping children, in order to maintain the correct ratio, in the event that a staff person must temporarily leave a classroom.

Standard #: 22VAC40-185-350-E-4
Description: Based on observation, interview and record review the center failed to ensure that the following ratios of staff to children are required wherever children are in care: *For children from three years to the age of eligibility to attend public school, five years by September 30: one staff member for every 10 children. Evidence: 1. There were 21 four-year old children (Pre-K class) with two staff when the inspector observed this group of children at 10:20am. a. The children were outside on the school age playground engaged in water play. b. Three staff were needed in order to maintained the required ratio of 1:10. 2. The attendance sheet (CSR sheet) indicated that the 21st child arrived at 10:15am. a. The accuracy of the arrival time of child #1 was verified by the staff working with the Pre-K class. 3. The Pre-K staff informed the inspector that they had alerted staff inside of the building that an additional staff person was needed as there were now 21 children in the group. 4. At 10:36am two staff continued to care for 21 four-year old children on the playground. a. The inspector went inside of the center and alerted staff #2 that 21 children were in care with two staff on the playground. b. Staff #2 asked staff #3 to assist with the children on the playground.

Plan of Correction: 1.) Going forward make sure that all new staff to include cook and current staff understand the importance of ratio to class numbers. Make sure that when another staff is needed in a classroom to cover ratio it is done ASAP. All new staff coming in will be trained in this area, all current staff as well: Continue to hire staff to keep building within ratio.
