22VAC40-191 Background Checks (22VAC40-191)

An unannounced inspection was conducted on 6/3/16 in response to the self reported incident of rough handling received on 5/27/16. The investigation was initiated on initiated on 5/27/16 and concluded on 6/20/16. Staff, a child and administrators were interviewed on site and by telephone. Staff and a child records were reviewed. Based on the information gathered a violation regarding rough handling has been cited and may be reviewed on the violation notice. Additionally, a violation regarding background checks was found not reported and will appear on the violation notice. Upon receipt of the inspection documentation, the licensee must develop a plan of correction for each violation. The plan of correction must include the following: ? The steps to correct noncompliance with the standard(s); ? Measures to prevent reoccurrence of noncompliance; ? Person(s) responsible for implementation and monitoring of preventive measure(s); ? Date by which noncompliance will be corrected. The licensee will have ten calendar days from receipt of the inspection documentation to complete the section titled Plan of Correction, sign each page of the documentation and return it to the Licensing Office by 7/25/16. The licensee should retain a copy to be posted at the facility (Supplemental Information is not to be posted due to confidentiality). Results of the inspection documentation are subject to public disclosure and will be posted on the VDSS web site within 15 calendar days, regardless of whether the Plan of Correction section is completed.

Standard #: 22VAC40-185-410-1
Description: Based observation and interview the center failed to ensure that forbidden actions are not used. Evidence: Child 1 was present for care at the center from approximately 8am until 6:25pm. Immediately after leaving the center the parent of child 1 retuned returned with the child and disclosed that the had red marks on his arm. 1 - Reports provided by the center indicate that at 6:25pm on 5/26/16 red marks were observed on the the arm of child 1. 2 - Staff 1 reports that on the evening of 5/26/16 after 6:25pm child 1 reported "when staff 2 grabs my arm super duper hard and makes me cry." 3 - A photograph obtained from another resource, taken the day of the injury, shows two red marks on the inside of the child's left forearm. 4 - In a report dated 6/3/16 child 1 is quoted as stating "She snatches me real hard like this!" [child demonstrates by pinching his arm]

Plan of Correction: This issue was self reported by the school, and this employee is no longer with the company. All staff will be retrained on mandated reporting procedures on or before 8/29/16 and management will do daily classroom observations to ensure compliance.

Standard #: 22VAC40-191-40-D-1-C
Description: Based on observation and interview the center failed to ensure that background checks are updated as required. Evidence: 1 - The record for staff 2 contains a sworn statement or affirmation dated 10/11/2. The documented date of hire for staff 2 is 10/5/09. 2 - Staff 3 confirmed that the sworn statement was 10/11/12 and therefore, past due for update.

Plan of Correction: All background checks and sworn disclosures have been updated. Management will ensure that all staff have annual updated sworn disclosures done June 1 of each year. The DM will assist in getting this school set up on a staff management file to ensure that all forms are kept current.
