22VAC40-191 Background Checks (22VAC40-191)

An unannounced monitoring inspection was conducted on October 18, 2016 from approximately 1:00 PM to 3:00 PM. Three staff were present with fourteen children with additional staff on site for administrative duties. Children were observed napping and eating a snack. Licensing Inspector reviewed standards related to supervision, activities, equipment, napping procedures, nutrition, children and staff records, emergency evacuation and shelter-in-place drill documentation, liability insurance documentation, injury reports, emergency supplies and required postings. Violations were reviewed with and verified by the program director.

Standard #: 22VAC40-185-270-A
Description: Based on observation, facility did not ensure areas and equipment of the center, inside and outside, shall be maintained in a clean, safe and operable condition. Unsafe conditions shall include, but not be limited to, splintered, cracked or otherwise deteriorating wood; chipped or peeling paint; visible cracks, bending or warping, rusting or breakage of any equipment; head entrapment hazards; and protruding nails, bolts or other components that could entangle clothing or snag skin. Evidence: On October 18, 2016, the shed on the side of the outside playground has warped rusted panels with sharp edges. The door is open on the shed leaving exposed yard tools to include a rusty protruding pitch fork and piles of debris.

Plan of Correction: Pitch fork will be pushed back out of reach of children today. Shed will be torn down.

Standard #: 22VAC40-185-330-B
Description: Based on observation, facility did not ensure there is adequate resilient surfacing in the fall zones on the playground under and around climbing equipment or equipment with moving parts. Evidence: On October 18, 2016, there was 2" - 3" of mulch depth at the foot of the slides and along the side of the animal rocker. There should be at least 6" depth in these areas.

Plan of Correction: Mulch will be added.

Standard #: 22VAC40-185-340-F
Description: Based on observation, facility did not ensure children under 10 years of age are within actual sight and sound supervision of staff. Evidence: On October 18, 2016 at 1:07 PM, Licensing Inspector entered the toddler (age 17 months - 23 months) classroom and observed 5 children napping on cots. There was not a staff present in the room or within direct sight of the children. Staff #4 was observed entering the classroom at 1:09 PM.

Plan of Correction: Program Director will have a staff person present in the classroom at all times.

Standard #: 22VAC40-185-440-B
Description: Based on observation, facility did not ensure cots are identified for use by a specific child. Evidence: On October 18, 2016, 2 of 3 children napping on cots in the infant room did not have a cot identified for use by that child.

Plan of Correction: In the future, the children's cot will be taken with them if they nap in another room.
