22VAC40-185 SPECIAL CARE PROVISIONS AND EMERGENCIES.
An unannounced inspection, record review and interviews took place on October 11 and October 14 following receipt of a self-reported concern. The following standards were inspected: 340 A: When staff are supervising children, they shall always ensure their care, protection and guildance. 400 A: In order to promote the child's physical, intellectual, emotional and social well-being and growth, staff shall interact with the child and one another to provided needed help, comfort, support and respect personal privacy; respect differences; encourage decision-making abilities; promote ways of getting along; encourage independence and self-direction and use consistency in applying expectations. 400 B: Behavioral guidance shall be constructive in nature, age and stage appropriate; intended to redirect children to appropriate behavior and resolve conflicts. 410: The following actions or threats are forbidden: physical punishment; enclosure in a small space; verbal remarks which are demeaning to the child. After careful consideration of the facts presented in this case, there was not a preponderance of evidence to support the concern. Therefore, this is being considered invalid.
