22VAC40-191 Background Checks (22VAC40-191)
An unannounced monitoring inspection was conducted today from 9:30am-1:00pm. There were 39 children (infants-5yrs.) directly supervised by 9 staff. The physical plant, 5 staff records, 5 children?s records, evacuation drills, injury reports, emergency supplies, and policies were inspected. Required documents were posted. Children were observed participating in group play, playing outside, playing with puzzles, and doing activities for fine motor skills . Diapering and hand-washing procedures were also observed. There was ample space and an abundant supply of materials for the children. The center was clean and organized. Areas of non-compliance are identified in the Violation Notice. Standard #: 22VAC40-185-270-A Description: Based on observation areas inside the center were not maintained in a safe and operable condition. Evidence: Tiles were missing in front of the sink in the Discovery room. Two out of four toilets in the bathroom closest to the Discovery room were missing bolt covers at the base of the toilet (bolts were exposed and protruding upward). The floor drain in the same bathroom was sunken, with no cover to make it flush with the floor and was therefor a tripping hazard. Plan of Correction: The Director stated she will contact maintenance to fix everything right away. The maintenance service is already aware of the tiles.
Standard #: 22VAC40-185-350-E-4 Description: Based on record review, staff interviews and observation, the three's class was over ratio by 1 child, while inspectors were in the classroom. The staff ratio should be 1 staff/10 children for this age group. Evidence: The head attendance sheet indicated there were only 10 children, the staff member stated she only had 10 children but acknowledged she was over ratio when inspectors counted 11 children in the classroom. An assistant was immediately called. Plan of Correction: Director stated she will retrain staff members on attendance policies and filling out attendance forms and maintaining classroom ratios.
Standard #: 22VAC40-185-420-A Description: Based on record review staff did not request annually parent confirmation that the required information in the child's record was up to date. Evidence: Two out of five records reviewed did not have an annual update. Child #1 was last updated in 2014 and child#2 was last updated August 4, 2016. Plan of Correction: Director will contact parents immediately.
Standard #: 22VAC40-185-500-B Description: Based on observation, disposable diapers were not disposed in a leakproof or plastic-lined storage system that is either foot operated or used in such a way that neither the staff member's hand nor the soiled diaper touches an exterior surface of the storage system during disposal. Evidence: The trash cans in the toddler and infants rooms, contained trash cans that required the teacher to push a button or use their hands to open the lid. Plan of Correction: The Director stated that she will purchase new trash cans.
