63.2 Licensure and Registration Procedures
The Licensing Inspector for the Happy Feet Early Learning Center conducted an unannounced Monitor Inspection on December 15, 2017. Upon arrival at 11:55 AM there were a total of twenty-one (21) infant and pre-school age children present under the direct care & supervision of three (3) caregivers. Adult to child ratios were not in-compliance upon arrival. Licensing Inspector was unable to review staff and children records; records were requested but not provided. LI Anderson observed children during arrival/departure procedure, rest/sleeping activity, bathroom/hand washing procedures, snack/meal served, group activities, self-initiated activities and homework/quiet time. Areas of non-compliance and the Risk Assessments found during today?s inspection were reviewed the Center. Standard #: 22VAC40-185-350-D Description: Based on observations, the Licensee failed to ensure that the ratio of staff to children during the designated rest period may double the number of children to each staff required by subdivisions E2 through 4 and 7 of this section (children ages 2-4 years old) and that an additional person is present at the center to help, if necessary. EVIDENCE: Ratios were not maintained for children ages birth up to 16 months. Upon arrival during the designated rest period, there were 3 staff members providing care for 21 children. Attendance in each group of children: Classroom #1 there were six 2-3 year old children under the care of 1 staff member Classroom #2 - there were 3 infants and 7 children ages 16 months - 23 months under the care of 1 staff member Classroom #3 there were five 3-5 year old children under the care of 1 staff member. In Classroom #2, adult to child ratios were not maintained for infant children. Infant children ages birth up to 16 months are excluded from the designated rest period exception. Ratios for children birth up to 16 months must be maintained at 1 staff member for every 4 children at all times (22VAC40-185-(5)-350-E-1). Plan of Correction: Ratio will be maintained at all times. Standard #: 63.2-1708 Description: Based on inspection, the Licensee failed to provide records and reports available to the Commissioner's representative as required. EVIDENCE: Licensing Inspector was unable to review children & staff records and the Emergency Preparedness Plan. Licensing Inspector requested to review Center records upon arrival and was not provided with the records during the inspection. Plan of Correction: Will allow record review upon request
