22VAC40-191 Background Checks (22VAC40-191)
- Technical Assistance:
Discussion was held on the topics of current enrollment, current staffing, and a review of changes to background checks with regards to expiration dates, new fingerprint checks to be done through Fieldprint of Virginia & Office of Background Investigations (OBI), new sworn disclosure statements, and to obtain CPS checks from other states as listed from the past five years. The roll out for the new fingerprint checks will occur in January 2018. More information shall be sent to you about this process. All finger print checks for existing employees must be started for each according to the established time table and then completed by September 30, 2018. New employees will not be allowed to start until an ?Eligibility Letter? is on file. Discussion of 63.2-(17)-1720.1-B-3 results of searches in VA and out of state. An out of state CPS check was sent for Staff #4 on 09/08/2017. As of today's date, the status of this request was unknown. A call was placed today to inquire the results. The center will now conduct a follow-up for all out-of-state CPS requests within a 45 day period and document accordingly. A new request shall be sent to the State of Texas for this documentation.
The following inspection took place between the hours of 10 am through 4 pm. Today, I met with the Staff of the KinderCare Learning Center located in Springfield, Virginia. At the start of this unannounced monitoring inspection there were a total of 66 children with 9 staff; good ratios in all 4 rooms. A total of 11 children?s files and 7 staff files were reviewed. The children were engaged in the following: center play within the classroom, large motor skills activities on the playground, hand washing, diaper changing, bathroom breaks, story time, lunch, nap time, and other organized activities. Standard #: 22VAC40-185-60-A Description: Based on review, 2 of 11 children's files reviewed indicated that not all of the required information was contained within each child's record. Evidence - 1. On the date of inspection (01/18/2018), the following children were missing emergency contact information: Child #1, and Child #2. 2. Child #1 had no emergency contact information listed (0 of 2), and Child #2 was missing an addresses for 1 of 2 of the emergency contacts listed. Plan of Correction: The Parents for both Child #1, and Child #2 shall be contacted and the information shall be obtained.
Standard #: 22VAC40-185-70-A Description: Based on review, 1 of 7 staff files were not available for review. Evidence - 1. On the date of inspection (01/18/2018), Staff #7 was on loan from another sister center. Staff #7 was observed in a classroom providing care for the children. 2. The Center Director informed the Licensing Inspector (LI) that there was not a current staff file for Staff #7 kept on site, but was located at Staff #7's "home" center. Plan of Correction: A copy on Staff #7's file was faxed to KinderCare #875. Staff #7 will be instructed to bring her file with her to the center, when in the future, this staff person is on site.
Standard #: 22VAC40-185-270-A Description: Based on observation, equipment inside the center was not maintained in a operable and/or safe condition. Evidence - 1. On the date of inspection (01/18/2018), a foot operated, flip-top trash can used for the disposal of diapers was not operable within the Toddlers/2 year old room. 2. A green wedge triangle mat within the Toddlers/2 year old room showed signs of heavy wear; displaying fraying along its edges and in its corner. A red/blue mat couch within the 2's room showed a rip in the middle of its seat; showing the foam inside. Plan of Correction: 1. The trash can was fixed on the date of inspection. 2. Both mats were removed from their classrooms on the date of inspection. New mats may be purchased in order to replace those that were removed.
Standard #: 22VAC40-185-510-C Description: Based on review, the center administered outdated medication. Evidence - 1. On the date of inspection (01/18/2018), 2 of 7 medications observed on site were expired. Two medications prescribed to Child #1 had expiration dates of - (for medication #1) 12/2017, and (for medication #2) 06/2017. 2. According to the center's medication log, Child #1 was administered Medication #2 on 12/04/2017. This would have been 6 months after the date of expiration. Plan of Correction: Both medications shall be returned to the Parent of Child #1.
