22VAC40-185 STAFFING AND SUPERVISION.
The licensing inspector conducted an unannounced complaint inspection in response to a complaint that was received by the licensing office on 02/05/2018. Interviews were conducted with staff and inspections of each classroom throughout the morning were completed relating to allegations that ratios were not being maintained as required. The preponderance of the evidence gathered during the investigation supports allegations, so the complaint is determined to be valid. Please contact me if you need further assistance. Thank you. Standard #: 22VAC40-185-350-E-1 Complaint related: Yes Description: Based on interviews with staff the facility failed to maintain compliance with this standard as required regarding ratios. Evidence: Interviews with staff on 2/12/18 verified that on 2/2/18 the ratio was not met as required in the Tiny Tigers 1 classroom, aged 6 weeks-14 months, for approximately 10-15 minutes when a staff member did not come into work as scheduled, notifying the director 5 minutes prior to the start of her shift that she would not be coming in and was quitting. Staff verified , during interviews, that there were 7 children in care with 1 staff member during those 10-15 minutes until a substitute arrived.; the required ratio is 1 staff to 4 children. Staff also verified through interviews that the age range of the children during this time was 3 months-14 months. Staff stated during the interviews that maintaining ratios in the mornings is often hectic as arrival time of children is hard to gauge, but that staff do come to assist once the ratio becomes non-compliant and the director is notified of the need for more staff coverage; until the next scheduled staff member arrives for the shift. Plan of Correction: Staffing and scheduling has been adjusted to ensure that ratios are being met on a daily basis.
Standard #: 22VAC40-185-350-E-4 Complaint related: No Description: Based on observations on 2/12/18 the facility failed to maintain compliance with this standard as required relating to ratios. Evidence: On the morning of 2/12/18 the preschool classes, lower building ages 3-5 years, were combined during breakfast and post breakfast activities. and had not yet split up to go to their classrooms. When the licensing inspector arrived to verify ratios at 9:05am there were 22 children with 2 staff. The required ratio is 1 staff to every 10 children, therefore they were over ratio during this time. Interviews with staff determined that 2 children had arrived for care approximately 5 minutes prior to the inspectors arrival, making them out of ratio for approximately 5 minutes. At 9:10am another staff arrived and the classes split allowing for the required ratios to be maintained. There were then 8 children with 1 staff in a classroom, and 15 children with 2 staff in another classroom.
