Comments:
The licensing inspector conducted an unannounced complaint inspection in response to a complaint that was received by the licensing office on January 16, 2018. Interviews were conducted with staff and the program director. The complaint investigation was initiated on 1/17/18 and concluded on 3/15/18. The investigation is in response to allegations of lack of a child being fed a food to which he was allergic. The information gathered during the investigation supports the allegations, so the complaint is determined to be valid. Violations were found in the following areas and appear as violations on the violation notice: documentation, care and protection, records accessible, no designated staff in charge of center.

Description: Based on observation and interview the center failed to ensure that staff and children's records are treated confidentially. Evidence: 1 ? Staff and children?s records are stored in the office of the center. However, while investing the complaint on 2/19/18, 3/9/18 and 3/15/18 staff were observed accessing the children and staff records by walking into the office and opening file cabinet draws. a. The files were accessible to any one entering the office and therefore, the contents of those records were not treated confidentially.

Description: Based on interview the center failed to ensure that when staff are supervising children, they always ensure their care, protection, and guidance. Evidence: There is written documentation in the record of child 1 that states he is allergic to nuts. 1 ? Staff 1, 2, 3 4 and 5 stated that on Tuesday, January 16, 2018, child was served a peanut butter and jelly sandwich for lunch. 2 ? Staff 1 and 5 stated that child 1 had eaten ? of the entire sandwich when staff 5 came out and took the peanut butter and jelly sandwich away. 3 - Staff 4 stated that she was unaware of and had not been informed that child 1 had a peanut allergy. 4 ? Staff 2 stated that some time after lunch child 1 vomited during afternoon snack. 5 ? Staff 2 stated that child 1 began complaining about being itchy closer to 5pm, after he had vomited.

Complaint related: No
Description: Based on observation and interview the center failed to identify one adult on the premises that is in charge of the administration of the center. Evidence: Upon entering the center on 3/9/18 there were two staff present caring for children. However, either of the staff could identify who was the designated as being in charge of the administration of the center in the absence of the program director and the owner.
