63.2 Adoption
22VAC40-191 Background Checks for Child Welfare Agencies

Comments:
An unannounced, mandated, monitoring inspection was conducted on November 13, 2019 from 11:00 am to 2:30 pm and on November 14, 2019 from 10:30 to 3:00 at America World Adoptions. The agency reports no children in their custody at this time. There are currently 32 families approved and waiting for placement. The Director of Corporate Social Services and the Chief Operating Officer were available for the inspection and the exit interview at the end of the second day.

During this inspection, four adoptive home records and five personnel records were reviewed. Also reviewed were the background checks for seven adoptive home files, approved since date of last inspection. There was one citation for a violation of the Standards for Child Placing Agencies. It was a key health and safety standard.

An Acknowledgement of Inspection form was signed on this date.

Upon receipt of the Violation Notice, the licensee should develop a plan of correction to include the steps to correct non-compliance with the standard(s); measures to prevent re-occurrence of non-compliance; person(s) responsible for implementation and monitoring of preventative measure(s); and date by which noncompliance will be corrected. The licensee has five business days from receipt of the inspection documents to complete the section entitled "Plan of Correction", sign each page of the inspection documents and return to the Licensing Office. The licensee should retain a copy to be posted at the facility. Results of the inspection are subject to public disclosure and will be posted on the Virginia Department of Social Services public web site within five business days, regardless of whether or not the Plan of Correction is completed.

Description: Based on a review of the personnel records (P-1, P-2, and P-4) the agency failed to include required elements in the initial orientation provided to professional staff.

Evidence:
1) The personnel files of P-1, P-2, and P-4 did not include documentation of an orientation that included:

22VAC40-131-150.B.3.a. Procedures and requirements regarding adoption placement including intercountry adoptions if the child-placing agency is licensed to provide intercountry adoption services;

22VAC40-131-150.B.3.b. Services to birth and adoptive parents;

22VAC40-131-150.B.3.c. Assessment and evaluation of adoptive homes;

22VAC40-131-150.B.3.d. Services to children, including grief and loss issues;

22VAC40-131-150.B.3.e. Provision of post adoption services to families and adoptees; and

22VAC40-131-150.B.3.f. Current requirements of the Hague Adoption Convention, if applicable.

2) The agency representative acknowledged that there was no documentation of the required training.
